Here's what happened, he woke up and saw her sleeping, he got his brilliant idea and probably thought she was still drunk. He started... she woke up... he did some 'quick thinking' and CLOSED HIS EYES.. There you have it case closed :p

If any of you visit The Learning Channel every so often, as I do, it would be quite obvious he is a liar. Higher brain functions are proven to wake people up, as the show I was watching was working with people with insomnia, "sleep-walking" disorders, and a control group. Between all groups, those who were forced to do math problems either when they woke up or were forced to wake up at say, 2am, all showed the exact same alpha waves an alert person exhibits when they are awake. That is not to say they didn't all necessarily stay awake, those that were sleep deprived faded back into a semi-sleep beta wave state and eventually could not continue higher brain functions anymore, ie, their writing became chicken scratch or ceased all together.

With that background story in mind, all of us who have ever used a condom realize that it requires some thought. Even if you wake up a horny bastard and just need to have sex, the few seconds it takes to negotiate a condom wrapper and proper application of said condom would immediately cause you to become alert. Now after the guy's brain realizes what he's doing, he'd either A stop altogether B masturbate C wake up the potential partner to gain consent,  or D say "fuck it" Obviously he chose D, and since statistically speaking it was a 1 in 4 chance that he would pick D, he's just a sexual predator. Whether he needs psychiatric treatment or jail time or both is what the judgment should have been. If it happened to my girlfriend, I would castrate the man with a serated blade, end of story.
