Insane, but the way that the front pages were going, it might be much easier for the site to just have the one blog story then mass takeover of the site by the users. It was cool to watch the stories appear over and over again, the hundreds/thousands of them that there were. But then walking down to late night I relized that I kinda miss (mostly) real news. I see this going a few ways, one digg goes down, and probably down hard. Which would really suck, because Revision3 would go down with it. On the flip side this could just be the beginning of the internet revolution, and we as America can finally start moving the government, and the world, into the 21st century. Kubrick, here we come.

Another note, it doesn't really say that they will fight the cease and desist in court, but will take on any law action against them for it. (Which can't be much.)

yeah, good point.

The crazy thing is that this code has been public sinse February...and not nearly as many people knew about it until now.

Last night was crazy to watch.  Within 15 minutes, Digg got completely spammed with the key.  Now it's all over the place.

Well most of the fight came from the order of Cease and Desist, which, one has the key in it itself, and is government paper (jokes on them) and two did not only get the key taken down, but exploded it from 900 hits on Google to sub 300,000 on Google. The "digital Boston Tea Party" hit, overall I found it boring.

A friend of mine, and former FA member, had a shirt printed with the DeCSS code on it back in the day.  He took pictures and posted them on his website.  Within days he was getting C&D emails from lawyers representing the MPAA, telling him to remove the pictures of his t-shirt or they'd take legal action.

The DMCA, among other things, makes it illegal to distribute code that could be used to pirate intellectual property.  That's like making it illegal to distribute hammers because they can be used to break into houses.

It's a freedom of speech issue.  The MPAA shouldn't be able to tell you what you can or can't post on your blog.

Well, its not quite the same thing.  Dont' get me wrong, I do not feel sorry for these companies who are scrambling to keep their money in their pockets, but the above example just isn't the same.  A hammer's sole purpose is not to break into a house.  The purpose is to be used as a tool for legitimate purposes.  However if a tool was manufactured specifically for the purposes of performing an illegal act then this is a different story.  

As the former "man" anyone found in possession of "burglar's tools" was automatically under arrest.  In most cases, this had to do with the location and  context in which these tools were found, but in the case of lock picking tools, you have to be licensed to even have these in your posession otherwise you'd be spending jail time starting that night.

The point is that the hammer is not a good example.

Personally, i think these morons have enough money to be able to spare a little and pirating helps keep things on an even keel.  there are still more than enough people paying for their product to keep them comfortable long after they die so I could really care less.  However, if asked if its right or wrong, I'd have to answer that its wrong.

It all comes down to the fact that sometimes, as adults, we have to realize that regardless of the justifications we might come up with, whe have to admit some of what we do is wrong.  We have to be able to "man up" and take responsibility for this even if we choose to participate.  The "fun" comes in knowing its wrong and choosing to play the "game" anyway.  Just don't be a sore loser if you get caught.  This just means you didn't play the game well enough.

I do see your point, Phienyx.  But the original purpose of DeCSS and the purpose of the HDDVD hex code is to allow legitimate owners of the discs to play them on whatever hardware they choose.  If you walk into Best Buy, purchase an HDDVD, and develop a code that would allow you to play that disc on your toaster, the MPAA has no right to tell you not to.  If someone else out there wants to watch their HDDVDs on their toasters, you should be able to distribute the code that you developed so that they can enjoy their movies in "Toast-O-Vision".  The MPAA shouldn't be able to sue you because someone else used your code as a means of pirating their movies.

I'm not defending piracy.  I'm defending the free distribution of code.  People shouldn't have to waste time in court for having a combination of 32 numbers and letters posted on their websites.

The problem comes when one freedom infringes on the freedom of another.  One's freedom only extends to where another's begins.  Now if there are laws on the books prohibiting the free distribution of said code, then they have grounds to suit.  

But what I'm saying, if you're going to do wrong, have the balls to come out and admit it without shame if you get called on it.  Claiming ignorance or innocence is just insulting to one's own and to everyone else's intelligence.  If you're gonna do wrong be committed enough to it to not try to hide behind loopholes, willful ignorance and shifting of responsibility.  The problem is that if these people wore the balls they claimed to have and actually came out and admited to engaging in and encouraging piracy, they know damned well they wouldn't have a leg to stand on in the court of law.  The issues of piracy would never have gotten that far if the people involved actually knew how to keep their activities elusive and where it belongs......in the shadows and out of the public eye.  

Don't break into my house then try to feed me a line of bull when I come down with my big stick.  Sure, you COULD have been in there to clean my floors, but most likely not.  I'd have more respect for you if you tried to shoot me.  At least then, we're both clear and honest about our positions in the situation:  You're there to break in and jack me and I'm there to kick your ass the hell out of my house....let the games begin.
