Title: Commissioned Pictures
Post by: Phienyx on July 22, 2007, 09:15:03 pm
Has anyone heard anything lately on the illustrations they've commissioned?

Nein.

Someone ordered one for me in March (whoever it was, they were extremely nice, but Turret said he couldn't tell me... but I have my suspicions.. :) ) and I haven't heard anything from him in a while. I haven't seen him on AIM, nor has he responded to my PM's.

I originally ordered mine at the end of March and paid 1/2 of the $$ down and haven't heard anything either.

I call him frequently and crack the whip at him to get these done.  I'm hope I don't regret vouching for him here.

Here is his cell phone number:  813-367-6941; it's on his business card, which I'll scan and post here later, so there should be no issue with the number being posted or called.

Call him, and post what happens here.  It is ridiculous that it is taking this long; I know he's had periods of time where he has indeed been busy, but he still should have had an abundant amount of time to finish these.

I spoke with him Thursday, however, and he did state that he was working on yours, Phienyx.  Let's hope he is.

If anyone else is thinking of enlisting him for a commission, I recommend  you wait until this is resolved.

Also, Dagonet has been waiting since Feb. to get his done.

Ok, at this point I am going to be asking for a product or a refund on what I put down on what was supposed to be my character rendering.  I have heard absolutely nothing and my efforts to contact him have yielded no response.

Has anyone else had any better luck with either their portrait or contacting the Zack?

I left him messages on his DeviantArt page, he asked me to e-mail him.  I did, he didn't reply.

He is however still producing artwork for himself, so it's nice to know we basically subsidised his car repairs for him.

I didn't think I'd to have to put his apartment number up, but if you can't get him on his cell now, you can get him here.

813-412-4578

If anyone else is having problems, make sure to post here for everyone to take note, as well as PM me specifics on dates and money.

If you have problems with this number, we will move to the next step, even if I have to personally show up on his doorstep and have him talk to you over my cell phone. :)

Phi - has he answered back to any of your contact attempts?  What form of contact, and what was stated?

Yeah Zack is you're typical procrastinator.

He'll tell you what you want to hear so that you'll stop pestering him (so that he doesn't feel guilty)

He doesn't practice prioritizing, he'll do something fun long before he does "work"

He occasionally does work, and when he does it's always focused and good results. The trick is getting him to do it more often.

One problem with procrastinators is that if you push them too far, which you almost always have to do, they will get angry and resent you.

I'm saying all this from my own experience as a seasoned procrastinator.

Jeyk has the best idea, show up at his door step and oversee him working. It will piss of Zack, but tough shit.

He's kind of like a hot girl with severe emotional problems.

You know you want to, but if you do you also know there's hell to pay.

So hire at your own risk.

I personally don't have a problem working with procrastinators, but I realize other people here aren't as forgiving as I am when it comes to laziness.

I think if your going to buy from him, he needs to provide some work 1st.

Do alittle get alittle money....and so on until the project is complete, and maybe a direct contact number/address...

Yes, we are back on this subject again.

I am now at the end of my patience on this matter.  It would not be a big deal, but this involves money that I paid (and I"m sure has already been spent) and nothing has been produced.  Therefore I am sending the following message to Mr. Finfrock:

Ok man,

This is about the $30 I agreed to pay you as down payment for the portait of my MxO character, Phienyx, which I requested and you agreed to produce.  If you have forgotten, I submitted $30 on March 24, 2007.  Check your paypal history on that date if you have forgotten.

I think I've been plenty patient in regard to this matter but I think this lack of professional and even decent behavior in regard to the above mentioned subject has gone into the realm of ridiculous.  So, I am asking you to do one of two things.  Either produce the requested and promised work, or refund my $30 immediately.

Thank you.

You all may or may not find this to be a bit strongly worded, but be assured this is very toned down compared to what I'd actully say to him if I had the chance to address him directly face to face.  This is unacceptable in any circle.

If you have contact with Mr. Finfrock, I suggest you tell him to check his email and PMs.

Yeah... I paid him $15, because he said he would do a drawing to whoever gave him money to renew his MxO account. :(

I kinda gave up.

Well, I'm starting to wonder if this whole thing is a low level scam.  I'm quite sure that if enough of us got together who have had this problem with him, that some legal action could be taken, though it probably wouldn't be worth the cost.  I hope common decency kicks in for him at some point and he gets his ass in gear and decides if he is going to be a man and either refund the monies or produce the work.  Either or would be satisfactory with me.

if in england there would be no question of breach of contract and might also be theft too. Given you lot realised that our legal system is perfect and copied it I can not see why not there too.

the only problem you are likely to have is within what timeframe would he produce the commissioned works? if in england and silence as to time frame then a "reasonable" time is given.

You are right though; not worth the cost and the hassle.

How much does a civil court case cost if you're the one suing?

Sound off, how many people had something in progress that they already paid for?  So far, we have:

Phieynix
Tecknik
Dagonet

I called him a few minutes ago, and he claims that he's going to try and refund folks.

Were any of you able to get him at the apartment number I posted?

I have no excuse for why I have talken so long to do some commissions. What I've done is unprofessional, and just plain rediculious.

I currently plan on refunding anyone who wants me to do so as soon as I can afford to. If anything, I will be doing that by the end of the month (or at least trying).

You can email me at splashed_ink@yahoo.com for anything further.

With all due respect, the post is appreciated, but I don't think I am alone in saying that words from you mean nothing to me at this point.  Once I see some positive action that back up your words.....

Also contacting each person individually that you owe money or product to, might also be a step in the right direction.  I am not the only one who's pms to you have been ignored.

Although the situation may call for a bit of violence (because some people are so hardheaded that this is the only thing they respond to) I don't officially recommend it.

I am just hoping that common decency kicks in at some point.  At least some sense of manliness.  Like Scarface said: A man has his word and his balls and he don't break em for nobody.  Now if we can't count on your word as a man, then your balls deserve to be broken.

Unfortunately, it seems as if this is a joke to Mr. Finfrock or at the least not important enough to follow through because we are faceless entities that are out of mind as long as he doesn't look at this site.

Well, I wanted to avoid this, but it seems I'll have to try getting his attention in a more public manner.

I've tried all that I can on my side, and I do hope what you do will get the job done for the sake of all who paid.  I'm not sure what else to say.  I regret exposing you all to him, being that the situation has come down to this.

Well, no more than 15 minutes after I posted my messages on the Pixelated Pupils site, both in PM and in the off-topic forums, the deviantart site both in PM and in the comment area and via pm on Myspace, I received a refund and this note from Zack:

Here's the $30 I owe you. I apologize for the horrible and unprofessional inconvenience. I was trying to gather up money to pay you back earlier, but I've had some personal problems get in the way. If anyone else asks about the refunds, please tell them I'm try as hard as I can to fix this.

I'm sorry again.

I have to say I feel a little bad about having to go to this extreme, but its a done deal.  I just wish I could have seen what he would have produced based on what I asked.
